This privacy policy explains how PSTAGE INTL LTD (“us,” “we,” “our,” “PayStage”) uses and protects the personal data it gathers about its merchants (“you,” “your”).

The term “Personal Data” refers to information that may be used to identify, contact, or find a single person, or that can be used in conjunction with other information to specifically identify a single individual.

PayStage is committed to protecting the privacy of its merchants and customers by managing and utilizing their personal information in a manner that is compliant with applicable rules and regulations. We will make every effort to protect the privacy of all personally identifiable information, including but not limited to the names, addresses, phone numbers, and e-mail addresses of merchants and consumers.

Merchants that utilize our payment services also act as data controllers for their customers’ information. Customers of the merchant who wish to exercise their rights about the personal data held by the merchant are required to make direct contact with the merchant.

Please give the following a careful read to understand our policies on the treatment of your personal information. If you are unable to comply with this policy, you are free to discontinue using the services we provide and bring an end to our contractual agreement.

A. OUR RESPONSIBILITY

PayStage acts as the processor of the Personal Data that you and your customers have given, while you serve as the controller of the Personal Data.

PayStage, as authorized by law, collects the personal information you and your customers provide for the purpose of delivering and administering our services and boosting your satisfaction with our offerings.

You warrant and consent to the collection of the personal information that you and your customers have given and have accepted the terms of this Privacy Policy. You shall be responsible for all losses and damages that occur from the authorization.

B. WHY WE ARE COLLECTING THIS INFORMATION

Personal information will not be further processed in a manner that is incompatible with the following purposes for which we may collect, hold, use, and disclose information, and we may collect, hold, use, and disclose information about you as follows:

  1. to offer you our core features and services,
  2. to customize or personalize your experience of the site,
  3. for analytics, market research, and business development, including to operate and improve the site, associated applications, and associated social media platforms for advertising and marketing,
  4. to send you promotional information regarding our products and services, as well as information regarding third parties whom we believe may be of interest to you.
  5. for the purpose of maintaining internal records and conducting administrative tasks to fulfill our legal duties and settle any disputes that may arise between us.
C. SECURITY

PayStage protects personal data. PayStage keeps personal information from being accessed, processed, deleted, or used without permission by people who shouldn’t be able to or by accident. This protects you and your customers from unauthorized access and data theft. PayStage keeps your personal information and that of your customers in a safe place. Personal information about you and your customers can only be seen by authorized PayStage employees. SSL, firewalls, encrypting data, and limiting access are all used.

Technical and organizational measures are taken to ensure a level of security that is appropriate for the risk. These include pseudonymization and encryption of personal data, the ability to ensure ongoing confidentiality, integrity, availability, and resilience of processing systems and services, the ability to restore availability and access to personal data in a timely manner in the event of a physical or technical incident, and a process for regular testing.

D. DATA RETENTION

You agree that, because of money laundering laws and other applicable laws, your personal information and the information of your customers cannot be erased or sent. It will be kept on our designated platform for as long as it takes to provide our services and process payments for our merchants as determined by Article 5(9) of the Law of Georgia (including the records submitted in accordance with the procedure established by the of the Law of Georgia Article 6(12) of Law), in tangible or electronic form for at least five (5) years after terminating business relations with the client, unless a longer period is required by the relevant supervisory authority or other competent authorities for keeping such documents, and immediately submit such information (documents) to competent authorities when there are grounds determined by the legislation of Georgia. We also keep personal information for other legitimate business reasons, like meeting our legal obligations, settling disputes, preventing fraud, and upholding our agreements. These needs can be different for different kinds of data used for different things and for different lengths of time.

E. DISCLOSURE OF DATA

You agree that PayStage may disclose and transfer Personal Data that you and your customers have provided to Service Providers (“Service Providers”), a third-party subcontractor engaged by PayStage that, as part of the subcontractor’s role of delivering the services, processes Personal Data to assist in providing PayStage’ services (including but not limited to Merchant service, data entry, database management, promotions, products, and services alerts). These Service Providers will follow data protection rules.

You agree that PayStage may disclose and transmit Personal Data to law enforcement agencies, government and regulatory bodies, and other organizations as required by law or when disclosure is essential to comply with applicable laws, legal procedures, or questions from the appropriate authorities.

You agree and warrant to reveal all Personal Data operating facts to your customers. If non-disclosure causes loss or harm, you’re responsible.

F. NOTIFICATIONS AND PRIVACY POLICY AMENDMENTS

PayStage has the right to change or amend this Privacy Policy. If so, we’ll put the modifications and the date at the top of the page. Merchants may regularly check this policy to ensure that they are aware of the most updated version. Any changes to the processing of personal data as described in this Privacy Policy affecting the merchant will be communicated through an appropriate channel. In addition, merchant should read this Privacy Policy before providing any personal data to avoid future conflicts. If you continuously use the service after the effect of the amendment, it means you accept the new policy.

G. APPLICABLE REGULATIONS AND LAW

We safeguard personal data under the laws of Georgia.

By using our Sites and Services, you agree to the transfer of your Personal Data to other countries, including those with differing data protection legislation. Our Sites and Services aren’t available in all jurisdictions.

You agree that all matters relating to your access or use of PayStage, personal data, including in all disputes, will be governed by the laws of Georgia, without regard to the choice-of-law principles thereof.

H. DISCLAIMER

In case of a contradiction between versions, the English version prevails. The policy covers any personal data we collect, use, disclose, and store when you do business with us, visit our website, or contact us.

If you disable or refuse Cookies, certain services may be limited or unavailable. The obtained data lets us evaluate traffic trends and target your interests. This improves the website’s content and usability.
